Terms of Service

Last updated: 2026 · Template — have a licensed attorney review and finalize before launch.

This is starter language, not a substitute for legal counsel. ClaimFair operates in a regulated space (insurance / public adjusting) — your final Terms should be drafted with an attorney familiar with your states of operation.

1. What ClaimFair is — and isn't

ClaimFair ("we," "us") provides self-service software that helps policyholders understand their own insurance policy, organize and document their own losses, estimate values, and prepare their own correspondence. ClaimFair also offers an optional referral service connecting users to independently licensed public adjusters and attorneys.

ClaimFair is not an insurance company, not a public adjuster, and not a law firm. We do not adjust, negotiate, or settle claims on your behalf, and we do not provide insurance, public-adjusting, or legal advice. Information provided through the service is general in nature and may not apply to your specific policy, loss, or jurisdiction.

2. No guarantee of outcome

We do not and cannot guarantee that using ClaimFair will increase your settlement, that your claim will be approved, or that you will recover any particular amount. Any figures, estimates, or illustrations are informational only and are not a prediction of your result.

3. Eligibility & your responsibilities

  • You must be 18+ and the policyholder (or authorized to act for the policyholder).
  • You are responsible for the accuracy of information you enter and for meeting all deadlines in your actual policy.
  • You are responsible for reviewing, editing, and deciding whether to send any document the service generates.

4. Fees

Decoding your policy is free. The full toolkit is available for a one-time fee shown at checkout. An optional Win-Fee plan, where available, may charge a percentage of amounts recovered above the carrier's initial offer; any such fee will be disclosed in writing before you settle, and may be offered only through or with a licensed professional where required by law. Refunds are described at the point of sale.

5. Referrals

If you request a referral, we may share the information you provide with licensed public adjusters or attorneys in your area, and we may receive a referral fee. A referral is not an endorsement, and any engagement is solely between you and that professional.

6. Privacy

Your use of ClaimFair is also governed by our Privacy Policy.

7. Disclaimers & limitation of liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, ClaimFair is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

8. Changes

We may update these Terms; material changes will be posted here with a new date. Continued use means you accept the updated Terms.
